Abstract
It is thought that the Crime of Aggression was one of the most serious and dangerous crimes to the world. States have tried to make a provision on the crime of aggression since the Rome Conference in 1998. According to Rome Statute on the International Criminal Court, jurisdiction over the crime of aggression can be exercised only when the provisions of definition of the crime and of the Court’s jurisdiction are adopted in accordance with arts 121 and 123. The Review Conference of the Rome Statute of ICC took place in Kampala, Uganda between May 31 and June 11, 2010. States parties reached an historic agreement on the definition and jurisdiction of ICC over the Crime of Aggression by consensus in 12 of June, 2010. But there are some debates on definition and jurisdiction of the crime of aggression. This paper focuses on the new articles - article 8 bis, article 15 bis and article 15 ter. It reviews some debates on the definition and conditions for the exercise of jurisdiction and on the role of the Security Council in related to the crime of aggression. When the conditions about jurisdiction restrict the exercise of the Court’s jurisdiction and they can shield states' nationals committing the crime from being prosecuted, there will be injustice to international community as a whole. By analysing some interpretations of the new articles and debates, it intends to suggest a meaningful interpretation and to prevent challenges to the Court’s jurisdiction.
