Abstract
In South Korean case law concerning the internal decision-making process of religious organizations, such as churches and Buddhist temples, disciplinary trials, general assembly resolutions, and religious affiliation have been the subject of disputes. South Korean courts have held that the prohibition of reformatio in peius, a general principle of criminal procedure, applies to religious trials. In accordance with the principle of separation of church and state, the Supreme Court has established the principle of non-intervention in the internal decision-making process of religious organizations, such as the appointment of religious leaders and disciplinary proceedings of religious organizations, which are not subject to judicial review unless they are specifically related to the rights and obligations of the people or legal relations. In addition, if the decision-making of a religious organization is deeply related to the interpretation of religious doctrine or faith, it is not subject to judicial review even if the validity of the church's punishment is disputed as an issue of specific rights and obligations. The Supreme Court has held that the validity of a resolution by the general assembly of a church to elect a marginalized person as an elder is, in principle, not subject to judicial review by the court. However, a dispute over a resolution to discredit or dismiss a church minister or elder, the dismissal or expulsion of a temple abbot, the confirmation of the founder's status of a temple, or the validity of a resolution of the foundation's board of directors regarding that status, is subject to judicial review as a dispute over a specific right or legal relationship. The Supreme Court has ruled that it is improper for current and former chief priests to trade the position for money. However, it also ruled that a defendant corporation's act of appointing a plaintiff priest as a chief priest, while knowing about such a transaction but ignoring it, was not necessarily a violation of social order. This ruling is difficult to accept, both logically and emotionally. Not only does it lack a convincing legal explanation, but it also fails to meet the public's moral expectations toward religious leaders. In legal disputes over decision-making processes within religious organizations, courts have generally adhered to the principle of separation of church and state, but have shown that there are cases where judicial review is exceptionally permissible, and it is difficult for the public to clearly understand whether this is the case. In the future, it is necessary to accumulate more case law on this issue so that more specific and clear standards can be formed, and the relevant legal provisions and internal regulations of religious organizations should reflect this jurisprudence.
