EU와 캐나다간 FTA인 CETA는 투자챕터에서 양자간 투자의 활성화를 도모하면서 당사국에 이루어진 투자를 보호하기 위하여 투자유치국이 준수해야 할 주요 의무를 규정하고 있으며 투자 및 투자자의 보호를 위한 법적 장치를 규정하고 있다. CETA가 기존 FTA와 차별화되는 점은 종전의 투자자-국가간 분쟁해결절차(Investor-State Dispute Settlement, ISDS)에 획기적인 변화를 가하고 있다는 점이다. CETA에서는 ISDS를 통한 국가의 규제권한에 대한 도전을 합리적으로 제한하기 위한 여러 가지 시도들을 하고 있는데, 국가의 규제권한을 명확하게 하고 ISDS의 오남용을 방지하기 위한 규정을 두고 있다. 또한 상설 중재법원과 상소제도를 도입하고 있다. 이를 통하여 중재인의 중립성과 객관성을 유지하고, 중재판정의 일관성을 유지하며 불합리한 판정을 최소화할 수 있는 기회를 제도화하였다. EU는 이러한 중재법원 방식을 향후 FTA 협상이나 BIT 협상에서 강하게 주장할 가능성이 높으며 한-EU FTA의 개정과정에서도 중재법원 방식의 도입이 주된 의제가 될 가능성이 있으므로 한국도 CETA에 새로 도입된 조항에 대한 면밀한 검토를 통해 그 의미와 시사점을 분석할 필요성이 있다.
Abstract
The aim of this paper is to review and analyze the innovative provisions specified in investment chapter of CETA(Comprehensive Economic and Trade Agreement), which is concluded between EU and Canada. CEPA investment chapter stipulates all the obligations the Parties follow and provides a legal remedy available for investors when they suffer a damage from the measures taken by the host country. CETA reaffirms EU and Canada retain the right to regulate for policy objectives and provides more precise and specific standard of treatment to investors and investment. Also, CEPA introduces new dispute settlement mechanisms for investors such as a permanent arbitration tribunal and appeal system which are regarded as well-advanced system from the conventional ISDS. Such a court-type mechanism may be able to secure judges neutrality on a case and produce more consistent and uniform rulings. It is early to call CETA a success story but it is very likely that EU may push those provisions in FTA negotiations including a future Korea-EU amendment negotiation. In that regard, Korean government needs to do in-depth analysis on those provisions and set Korea’s position towards them.
