Abstract
Energy is more than mere goods to the nation. Most of the countries regard energy as national security matter. Energy also has indispensible connection with climate change. Recently, Canadian feed-in-tariff(FIT) programme has been brought to the dispute settlement table. Japan requested the establishment of WTO panel to examine the WTO consistency of the feed-in-tariff programme applied by the Canadian province of Ontario to renewable sources of energy. Feed-in-tariff scheme consist of above the market price tariffs that are fixed by government, and that grid system operation must pay for it. Another distinctive feature is priority in excess to grid. The aim of these schemes is to stimulate the production of renewable energy by providing substantial benefits to the operators of installations which generate renewable energy. Ontario's feed-in-tariff programme couples the benefits of the scheme with a domestic goods and service requirement by providing long-term contracts to developers of green projects. WTO ASCM provide prohibited subsidies within the meaning of Article 3.1(b) and the specific requirements examined in this case are i) financial contribution or income or price support ii) benefit iii) entrustment or direction iv) specificity involved in the Canadian's feet-in-tariff.
