Abstract

Recently, the Supreme Court of Korea presented the ""introduction of Korea type discovery system"". The introduction of discovery is worthy of consideration. Because the discovery is good means of solving evidence problems and finding of substantial truth. However, sufficient consideration of the problems of the emergence and characteristics of the electronically stored information(E.S.I.) should be followed. In the case of the United States, e-discovery is becoming another subject matter in itself. The expertise of E.S.I. is one of the main causes of the phenomenon has spawned such a wide range of issues with the rapid technological development. When introducing the discovery system, such problems are expected to be similar for us in the same form. This article reviewed the use of special master and mediation in the U.S. e-discovery, and the e-discovery special master program of the U.S. District Court for the Western District of Pennsylvania which are to overcome the problems of expertise of E.S.I. In terms sum up the main implication follows. First, judges and lawyers must ensure sufficient expertise in e-discovery as a general rule. If E.S.I. is sure to be utilized in the increasingly common evidence of way in the litigation, judges and lawyers having expertise in the E.S.I. should be obvious, but nothing special. Second, to ensure the expertise of judges and lawyers of the e-discovery requires continuous and systematic training. In order to ensure the expertise of judges and attorneys in a timely manner at a rapid reality, it is essential to train continuous and systematic education. Third, the use of special master and mediation on e-discovery can be the role of complementary measures. Judges and lawyers, even securing general expertise, in the case where new technology specific areas becomes problem, need professional help with special expertise. And e-discovery requires a ""cooperation"" between the parties in the lawsuit that extreme conflict between the parties has been premise. So it is difficult to solve alone expertise of judges and lawyers and the use of mediation has its own value.
