검시제도개선을 위한 논의와 노력이 그동안 국회, 학계, 관련기관 등을 중심으로 많이 있어왔지만, 현재까지 유의미한 결과를 도출해 내지는 못하고 있는 실정이다. 그 이유는 검시관련 기관 간의 오랜 갈등과 법의전문의 확보에 대한 구조적인 어려움이 배경에 깔려 있기 때문이다. 그 와중에 변사 또는 살인사건 현장에서의 잘못된 조치에 대한 국민들의 비난은 오롯이 경찰의 몫이 되고 있다. 따라서 사건현장에 대한 검시 및 초동조치 강화능력이 시급하며, 현재 시행되고 있는 경찰검시관제도는 이러한 문제점을 극복할 수 있는 현실적 대안이 될 수 있을 것이다. 그러나 현행 경찰검시관제도는 그 근거법령이 미비하고, 선발ㆍ교육과정ㆍ업무범위 등에 많은 문제점이 있어 활성화되지 못하고 오히려 위축되어 있는 상황이다. 외국도 우리와 마찬가지로 법의전문의 확보에 구조적인 어려움을 겪고 있다. 하지만 현실적 대안으로 법의조사관(medicolegal death investigator, 미국), 검시사무관(coroner's officer, 영국), 형사조사관(일본) 등의 제도를 통하여 이를 극복하려고 노력하고 있으며, 또한 그러한 제도들이 전문화ㆍ활성화되고 있는 추세이다. 따라서 우리도 현재의 경찰검시관제도를 보다 활성화하고 전문화하기 위해 다양한 방법들이 강구되어야 할 것이며, 그 첫걸음이 독자적인 법령을 제정하는 것이라 생각한다. 그 점에 입각하여 하나의 입법안을 제시해 보았다. 여기서 반드시 고려되어야 할 점은 다음과 같다. 첫째, 선발계획의 지속성이 유지될 것, 둘째, 선발과정에 법의학 지식에 관한 필기시험과목을 둘 것, 셋째, 교육기간의 정일화와 프로그램의 내실화를 확실히 할 것, 넷째, 업무범위를 현재 보다 넓히고 명확히 하여 대외적 활동을 적극적으로 할 수 있도록 할 것 등이 그것이다.
Abstract
Although there has been considerable discussion on death investigation system, the improvement of the system is not achieved. The reason may be the deep-rooted troubles among relevant agencies(especially between police and prosecutor's office) and a structural scarcity of medical examiners. In consequence, much blame for the wrong management in the scene of unnatural deaths and murders is toward police. So the strengthening of the death investigation management is necessary without delay. the medicolegal death investigator system may be the alternative plan. However the current medicolegal death investigator system in Korea has big problem. It is that there is no law on the system. Consequently, the current medicolegal death investigator system is now withering. Today, The America's medicolegal death investigator system and the corners' officers system in UK is evolving through specializing. We should benchmark the developed model of those countries, so that we should specialize and evolve the current medicolegal death investigator system through making law on the system. In making law on the system, the key points are as follows : Firstly, employment plan must be consistent. Secondly, a written examination on legal medicine must be taken mandatory in employing. Thirdly, the training period must be fixed and the training programs must have substantiality. Finally, the work scope of Medicolegal Death Investigator must be clear.
