디지털기기의 발달, 무분별한 성 관련 출판물 등의 범람으로 인해 지하철 공간에서의 ‘카메라등이용촬영(이하 불법촬영)’범죄가 성행하는 등 심각한 사회문제로 자리를 잡았다. 많은 여성이 심리적 불안과 공포를 느끼고 지하철을 이용하는 수준에 이르렀지만 이에 대한 근원적이고 체계적인 대응책은 세워지지 않고 있다. 지하철 불법촬영 범죄는 범죄자의 이성적인 판단을 통한 합리적 선택에 의해 실행되는 특성을 보이는데 합리적 선택에 있어 핵심적인 요소인 범행 기회를 차단할 경우 강한 범행 동기를 가진 범죄자일지라도 범죄를 억제하게 되는 결과를 기대할 수 있다. 이러한 사실은 상황적 범죄예방이 불법촬영의 효과적인 대응책이 될 수 있다는 것을 의미한다. 이에 본 연구에서 지하철 성범죄와 관련된 문헌자료의 분석과 질적 심층면담을 통해 지하철 불법촬영의 실태와 그 특성을 살펴본 후, 상황적 범죄예방의 25가지 기법에 근거하여 구체적인 대응방안을 제시하였다.
Abstract
Due to the development of digital devices along with a significant increase in sexual content that is readily accessible, the crime of unlawful surveillance in the subway has become a serious social problem, leading to a high level of anxiety and fear of crime among female passengers. Despite the ongoing issue, effective measures to prevent and respond to the crime have not been established. Based on the propositions of rational choice theory, it can be postulated that unlawful surveillance in the subway can be deterred by eliminating the opportunities. Therefore, the techniques of Situational Crime Prevention (SCP) could be used as effective preventative measures. This research aims to offer detailed measures to deter unlawful surveillance in the subway based on the twenty-five techniques of SCP after examining the state of the crime as well as offender characteristics by analyzing official statistics and conducting in-depth interviews.
