성적 소수(LGBT) 수용자 인권처우의 한계 및 개선방향에 관한 연구

초록

이 연구는 교도소 성적 소수 수용자의 인권처우 개선을 위하여 필요한 교정법령의 정비 및 관련 정책적 과제를 제시하는 것이다. 이에 따라 교도소의 성적 소수 수용자의 인권처우와 관련한 국제규약 및 성적 소수 수용자 대한 연구와 제도개선 노력이 활발하다고 평가받는 미국의 경우를 분석하여 롤 모델로 삼고자 하였다. 교도소의 성적 소수 수용자는 일반적인 수용자와 다른 성적 취향 및 성적 정체성을 사람으로서 이들에 대한 인권적 차원의 교정환경 및 정책이 필요하다. 교도소 성적 소수 수용자의 인권처우와 관련한 대표적인 국제규약은 세계인권선언, 시민적 및 정치적 권리에 관한 국제규약, 성적 지향과 성 정체성에 관한 국제 인권법 적용에 관한 족카르타원칙 등을 들 수 있다. 특히 족카르타원칙은 향후 한국의 관련법 정비 시 갖춰야 할 구체적인 가이드라인을 제시하고 있다. 미국은 교도소강간철폐법 제정과 성적 소수 수용자의 호르몬 치료권 등을 확인하는 등의 다양한 판례를 구축하였다. 그러나 교정현실에서는 교도관 및 동료수용자의 차별과 폭력 등의 문제가 완전히 해소된 것은 아니다. 다만, 연방정부는 주정부가 교도소강간철폐법 규정을 이행하지 않을 경우 교정 분야 보조금을 삭감함으로써 제도적인 개선을 꾀하고 있고, 교도소강간철폐법 위반 교도관에 대한 제재와 예방적 교육 등을 강화하고 있다. 국제규범 및 미국의 경우를 바탕으로 할 때 한국은 성적 소수 수용자의 인권처우를 강화하기 위해서는 몇 가지 과제를 우선적으로 해결해야한다. 첫째, 성적 소수 수용자 인권처우의 입법화, 둘째, 성적 소수 수용자에 대한 처우의 개별화 및 모니터링, 셋째, 성적 소수 수용자 전담 교정시설 및 거실지정, 넷째, 호르몬치료 및 성전환수술 등 성적 소수 수용자에 대한 의료적 접근 보장 등이다. 물론 이와 같은 교정당국의 당면과제 이외에도 사회 전반적으로 성적 소수 수용자에 대한 포용과 배려가 필요하다.

Abstract

The purpose of this study is to present the policy issues necessary for the treatment of human rights of LGBT prisoners. As a result, it analyzed the case of the United States, which is actively engaged in research on institutionalization of LGBT prisoners and institutional improvement along with The International Covenant on the Treatment of Human Rights of prisoners. A LGBT prisoner has a distinctive daily life style as a person with a different sexual orientation and sexual identity than a general prisoner. Therefore, there is a need for a special corrective environment and policy for LGBT prisoner human rights. The International Covenant on the Treatment of Human Rights in Prison LGBT prisoners includes the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, and Yogyakarta Principles on the Application of International Human Rights Law in relation to Sexual Orientation and Gender Identity: Yogyakarta Principles. In particular, the principles of the Yogyakarta Principles provide concrete guidelines to be followed in the course of the revision of related laws in Korea. The United States has established a number of precedents that confirm the PREA enactment and the right to treatment of LGBT prisoners. However, the problem of discrimination and violence of prison guards and fellow prisoners has not been completely solved in the correctional reality. Therefore, the federal government is trying to improve the system by reducing subsidies in the provincial correction field if the state does not implement PREA, and it is strengthening sanctions and preventive education for PREA offenders. In order to strengthen the human rights treatment of LGBT prisoners, Korea should resolve the following issues. First, the task of legislating the treatment of human rights of LGBT prisoners, second, personalization and monitoring of treatment for LGBT prisoners, third, the task of designing a living room for the LGBT prisoners, and fourth, the medical approach to LGBT prisoners such as hormone therapy and transgender surgery. Of course, besides the problems of the correctional field, the most important thing is the social leniency and thoughtfulness of LGBT prisoners.
