중국의 IT법제 입법동향에 관한 연구

Abstract

Since China has become a member of WTO, it is required to follow the obligation and principles of WTO in all fields, such as politics, economics, society, and culture. Also new issues has become important social subjects, which are concerning the protection of information, the merge of communication and broadcasting and so on. These change, ones of surroundings internal and external in China, are functioning as power to drive alteration of legal system regarding IT in China. Whether legal system regarding IT is mature or not could has an important effect on Korea. For example, Korean's personal information could be searched on Chinese portal sites and be used for evil purposes. Chinese malignant information could infiltrate into Korea. Like this, phenomena in Chinese IT have real and practical effects on us. This is the point where there is a need of studying legal system regarding IT. This article would divide Chinese legal system regarding IT into three fields, such as 'basic legal system, protection of information and opening information to the public, and broadcasting and communication'. Further This article would examine problems and major contents concerning legal system related to those. And in a whole view, This article would examine the problems about legislation form of Chinese legal system regarding IT.
