Abstract
This paper criticizes that current 2015 employee invention assignment system has the following problems. First, after receiving a report of an employee invention by the inventor-employee, the employer must give a document notification to the employee regarding its intent to assign within four months after receiving the report. If the employer fails to do so, the employee invention becomes a free invention and the employer does not have any right. In other words, the employer bears relevant risk of notice failure. Second, when the notification is arrived to the employee, the employee invention is being assigned at that time. Because of this strict provision, the employer cannot set an earlier assignment time. Third, if the employee, before or after the assignment to the employer, assigns the same employee invention to a third party bona fide purchaser for value, the third party can have priority on the employee invention. To avoid above-specified problems, this paper comparatively studies relevant systems of the U.S.A., Germany and Japan. Germany and Japan recognized such problems and the latter transformed from the inventor system to the employer system and the former has introduced a new system, under which notification failure is impossible and risk of dual assignment is being prevented. This paper preferably proposes to introduce a Japanese-style employer system and as a second alternative to introduce the following German-style system. First, the assignment time of an employee invention can be decided by an agrement between the employer and the employee, and for one example, the employee invention report time could be the assignment time. Second, to avoid risk of dual assignment, shall be introduced a special provision which does not protect a bona fide purchaser for value.
