The ownership system according to the socio-economic change in China

In March 2004, the National People's Congress, China's top legislature passed the amendment of Chinese constitution with landmark clauses which include the protection of the private property and the encouragement of private enterprise. Constitution was amended according to the theory 'from the country of farmer and laborer to the country of farmer and laborer and private enterprise'. Among other things, a clause stating the country respects and preserves human rights has been added to the first article of the chapter on basic rights and obligations of citizens. The status of entrepreneurs has been bolstered and now they can be more confident in developing their business through the amendment. Chines laws related to the ownership system are constitution, general rules of civil law, estate administration law and city real property law. The most important thing is the part of a real right which is provided in chapter 5 § 1. As for the estate ownership, nation estate ownership and mass estate ownership are approved, private estate ownership, however, is not. As it is, building ownership toward private is approved. So, the related laws endow private and enterprise with the use of the nation owned estate and mass owned estate. This thesis has focused on the present Chinese ownership system and the prospect which Chinese social changes will effect on it.
