유엔해양법협약은 회원국에게 합리적 보석금 또는 다른 재정적 보증이 예치된 경우 체포된 선박 및 선원을 신속하게 석방해야할 일반적 의무를 부여하고 있지는 않다. 협약 제292조는 합리적 보석금 또는 다른 재정적 보증이 예치된 경우 즉시석방 해야 할 다음과 같은 의무 규정을 위반하였다는 혐의가 주장되는 경우에 한하여 강제 분쟁해결절차가 즉시석방 문제를 다룰 수 있도록 규정하고 있다. 첫째, 배타적경제수역에서 연안국의 생물자원 탐사·개발·보존 및 관리하는 주권적 권리의 행사를 위해 채택한 국내법을 위반한 선박을 나포한 경우(협약 제73조 제2항), 둘째, 영해 및 배타적경제수역을 항행중인 선박이 배타적경제수역에서 선박으로부터의 오염의 방지, 경감 및 통제를 위하여 제정한 국내법을 위반하여 위반 선박을 나포한 경우(협약 제220조 제7항, 제226조 제1항(b)) 신속한 석방 의무를 규정하고 있다. 협약의 신속한 석방과 관련한 다양한 문제에 대하여 국제해양법재판소는 상당히 종합적인 법리를 발전시켜왔다. 그러나 선행연구들은 이들 각 사건들에 대한 개별 분석에 그치고 있으며 신속한 석방과 관련하여 발생하는 법적 쟁점에 대한 판례의 흐름이나 종합적 분석을 다루고 있는 연구를 찾아보기 어려웠다. 이에 이 연구는 국제해양법재판소의 신속한 석방 관련 판례들을 검토하여 협약의 신속한 석방절차와 관련한 주요 법적 쟁점을 추론하고 시사점을 제시하고자 한다.
Abstract
A State Party does not have general obligations to release arrested vessels and their crews promptly upon the posting of reasonable bond or other financial security under the UNCLOS. Article 292 provides that only where the authorities of a State Party have detained a vessel flying the flags of another State Party and it is alleged that the detaining State has not complied with the provisions of this Convention for the prompt release of the vessel or its crew upon the posting of a reasonable bond or other financial security, the question of release may be dealt by compulsory procedures. The provisons of the Convention regarding the duties of the prompt release are followings. First, in the case of arrest the vessel or its crew who violates domestic laws and regulations adopted in the exercise of its sovereign rights to explore, exploit, conserve and manage the living resources in the EEZ. Second, if the investigation indicts a violation of applicable laws and regulations or international rules and standards for the protection and preservation of the marine environment. ITLOS has developed synthetic reasoning in relation to the prompt release under the Convention. Preceding researches, however, focus on the individual analyse of the prompt release cases. This paper hereby draws main issues about prompt release procedures by studying the cases of ITLOS concerning prompt release, and provides its implications.
