Abstract
Japanese-like expressions and writing style have remained in Korean law texts because the early constitution of the modern law system in Korea was adapted and translated from the Japanese written law. Another reason for the use of Japanese-like expressions and style might be the lack of consideration of the Korean language from the linguistic point of view. This seems to be the case with the Korean civil law which was constituted in 1958. This paper analyses the reality of Japanese-like expressions found in the present civil law text by comparing the usage and style of Japanese and Korean civil law texts. To read Japanese, we have used the sounds of the Chinese characters or it's meanings. We call the former Eum Dok(音讀) and the latter Hun Dok(訓讀). The present study focuses, in particular, on how Japanese Hun Dok native words and Eum Dok Chinese words in Japanese texts influence on the Korean text. Although the expressions seem to have already been set in Korean, many of them need to be changed through a total revision of the civil law text. The whole process of the revision should adhere to the following principles: Simplicity, originality, standardization and a eliminating any authoratative tone. It should be carried out without deviating from the original meaning of the law text. It is obvious that Korean and Japanese are two very similar languages in structure. From the Comparative Linguistics point of view, however, differences have be considered despite similarities.
