Judicial Control on Prosecutorial Power in German, Japan, and Korea

German has adopted compulsory indictment and compulsory-prosecution system, and Japan discretionary indictment and quisi-prosecution system as a control measure of prosecutorial power. The Korean lawmakers of Criminal Procedure Act(CPA) adopted the quisi-prosecution system in 1954, but the scope of its application had been limited to the crimes of public officials by the military government in 1973. Since then it's function as a control instrument over the abuse of prosecutors' power has been turned off. * Professor, School of Law, Chonbuk National University Growing public have requested to extend the scope of its application on all crimes, and the President Committee on Judicial Reform prepared a bill for revision of CPA in 2006. But the revised CPA allowed only the persons who lodge complaints to apply for ruling and changed the quisi-prosecution system with the compulsory prosecution system. The abuse of prosecutorial powers has become more serious social problem in Korea. Many people are demanding to substitute the compulsory-prosecution system with the quisi-prosecution system to control the prosecutorial discretion effectively. This study will analyze the two systems and explore ways toward the moderate system the check the authority of the prosecution in Korea.
