M.L. and W.W. v.

Abstract

The advent of the internet and artificial intelligence has revolutionized the way we communicate and express ourselves, and poses new challenges to protecting individual privacy. The right to be forgotten, enshrined in Article 17 of the GDPR (General Data Protection Regulation), symbolizes the conflict between privacy and freedom of expression, giving individuals the right to request that their personal data be removed from online platforms. This article aims to examine the balance between these competing rights in the digital age. The right to be forgotten is the right of individuals to request that their personal data be deleted when it is no longer needed, or when they withdraw their consent. This right aims to mitigate the long-term negative consequences of outdated or irrelevant information online. It came to prominence in 2014 with the Google Spain case, in which the Court of Justice of the European Union (CJEU) ruled that individuals can request the deletion of their personal data under certain conditions. Freedom of expression is a cornerstone of democratic societies, ensuring the free exchange of ideas and information. It is protected by Article 10 of the European Convention on Human Rights (ECHR) and supports transparency, accountability, and the public's right to know. However, this right must be balanced against the right to privacy, and public interest must be carefully weighed against the potential harm to individual privacy. The digital age has blurred the lines between the private and public spheres, making it difficult to respect freedom of expression while protecting privacy. Information shared online can be permanent, making it difficult to control an individual's digital footprint. The case of M.L. and W.W. v. Germany at the European Court of Human Rights illustrates this conflict, where individuals attempted to remove their criminal records from public access. The case highlights the balance between public interest and individual privacy rights. As internet intermediaries, search engines and social media platforms play an important role in the management of online information, and protecting online privacy poses significant challenges due to the permanence of online information. Once data is in circulation, it is difficult to completely erase it, necessitating legal and ethical discussions about managing digital footprints. This emphasizes the importance of the right to be forgotten, which allows individuals to regain control over their personal data. In the digital age, it is essential to balance the protection of personal privacy and freedom of expression.
