최근 디자인 분야에서는 타인의 디자인을 도용하거나 디자인권을 침해하는 사건에 대한 법적 분쟁이 빈번하게 발생하고 있고, 디자인권에 대한 사람들의 인식과 관심도 또한 높아지고 있다. 하지만 이처럼 디자인 분야의 법적 분쟁에 대한 논의가 활발해지고 있음에도 불구하고 학계에서 이와 관련하여 어떠한 논의가 이루어지고 있는지에 대해 살펴본 연구는 거의 이루어지지 않고 있다. 이러한 점에 착안하여 본 연구는 디자인 분야의 법적 분쟁에 대한 학계의 논의를 살펴보는 것을 목적으로 진행되었다. 특히, 디자인 산업 내의 세부 전공에 따라 법적 분쟁과 관련하여 어떤 연구가 진행되었는지를 살펴봄으로써 각 분야에서 진행된 선행연구들이 어떠한 내용에 초점을 두고 연구를 진행했는지 파악해보고자 하였다. 이를 통해 본 연구는 디자인 분야의 법적 분쟁에 대한 현 시점의 연구경향을 파악하고, 향후 이와 관련한 연구가 진행되는데 있어 보다 다각적인 차원의 연구가 이루어질 수 있도록 하는 기반을 제공하고자 하였다.
Abstract
Recently, in the design field, legal disputes over cases of stealing other people's designs or infringing on design rights are frequently occurring, and people's awareness and interest in design rights is also increasing. However, despite the fact that legal disputes in the design field are being actively discussed, there have been few studies on what kind of discussion is being made in the academic world. With this in mind, this study was conducted with the purpose of examining the academic debate on legal disputes in the design field. Especially, by examining what kind of research has been conducted in relation to legal disputes according to the specific major within the design industry, it was attempted to understand what kind of content the previous studies conducted in each field focused on the research. Through this, this study tried to understand the current research trends on legal disputes in the design field, and to provide a basis for more multifaceted research in the future.
