초록

Government-owned Information, data, and works can be freely used in each countries‘ free use policy, and the free use policy has been carried out in Korea as well. Article 24-2 of the Copyright Act stipulates that anyone can freely use works owned by the government as public works, and the Korea Open Government License(KOGL) supports the free use policy. However, it seems that discussion and supplementation are needed about issues such as clarification of scope of public works, relationship with public data, necessity of the KOGL, works produced by government contracts, and commercial publication. This study looks into development process of the free use policy, examines what the Public Sector Information(PSI) and Open Government Data(OGD) were created in the process, and how they relate to public works. Additionally, after comparing the free use policy in the US, the UK, and the European Union, the points to be improved for the free use policy in Korea and the improvement plans are suggested: for example, restriction on the claim of copyright including moral rights, guideline to prevent commercial publication, guarantee of global use, and simplified conditions of free use in license. Finally, it is expected that the free use policy in Korea will not only be improved, but also serve as a model that can be referenced in other countries’ free use policies.
