Abstract
The scope of a trademark protection actually relies on its distinctiveness and consumer recognition. The stronger a mark, the more protection is given and vise versa. If the quality of goods is guaranteed for a mark, the mark has strong possibility to be a famous mark. In this sense, reputation of a mark can be evaluated as the extension of a mark's distinctiveness. This can justify why a famous mark must receive stronger protection. However, it is still controversial what the limit of protection is for a famous mark. Basically, a famous mark is a kind of a mark. It is difficult to find the reason why a famous mark must be received differentiated protection. Thus, in the past, the stronger protection for a famous mark was explained based on basic trademark protection theories such as distinctiveness and likelihood of confusion. The introduction of dilution protection caused chaos in a trademark protection system. Why a famous mark is protected without any confusion is not clearly explained. In the U.S., some courts expand an existing confusion theory and find some confusion even for dilution. However, it is doubtful whether courts can ask confusion continuously for dilution protection in contrast to the statutory definition. Since its enactment, dilution act has affected adversely to a trademark protection system. In a first-to-register country, the meaning of registration is weakened as a base for protection and in a first-to-use country, the meaning of use is weakened as well. However, it may be too late to reexamine its legality and usefulness. Rather, in spite of such a controversy, the extent of dilution protection tends to expand. Therefore, the category of famous mark must be strictly limited in order to embrace social demand for famous mark protection maintaining a current trademark protection system.
