Abstract

The issue of who will own an invention created at a university using federal funding is fundamental to vitalizing the technology transfer market. In the US, the Bayh-Dole Act allows a university research institute conducting government-funded project to retain the rights to any resulting inventions. Korea has an act similar to the Bayh-Dole Act. However, Korea and the US have several differences in how they regulate a university invention. For example, in the US the legal relationship between a professor and a university is controlled by contract, while in Korea it is controlled by statute. This distinction has led to different results in factually similar situations. The US Supreme Court, in Stanford v. Roche case(Bd. of Trs. of the Leland Stanford Junior Univ. v. Roche Molecular Sys., 131 S. Ct. 2188 (2011)), held that the Bayh-Dole Act does not prohibit a third party from obtain rights to a federally funded invention when it acquires those rights through a legitimate assignment that takes effect prior to a university’s employment contract. However, the opposite decision would be reached in Korea. As international cooperative research programs increase, understanding the differences in how the Korean and US legal system treat federally funded invention becomes vital.
