지역신문 발전지원 정책에 관한 법적 고찰

현재 국내 지역신문사들은 중앙일간지 중심의 시장구조와 경쟁력 약화로 자생력을 잃고 있다. 중앙정부는 지역신문 지원정책을 마련하고자 2004년도에‘지역신문발전지원 특별법’을 제정하였으며, 지방자치단체들 역시 2010년도부터 관련 조례를 만들고 있다. 그러나 지역신문 지원정책은 일시적인 지원으로 규정되어 있고, 운용하는 기관에 따라 세부내용들이 상치되어 다양한 문제들을 야기하게 되었다. 이러한 배경 하에서 본 연구는 지역신문 발전지원 정책에 대한 법조항들을 비교분석하여 특성들을 파악하고자 했다. 이를 위해 우선 지역신문 발전지원 특별법과 시행령의 개정결과들을 분석하여 정책의 변화양상을 도출하였고, 특별법의 제정 근거가 되는 관련 법안들인 정간법과 신문법, 잡지법 등을 비교하였다. 마지막으로 특별법이 시행된 이후에 제정된 지자체별 지역신문 지원조례들을 분석하여 각각의 특성과 차이점들을 찾고자 하였다. 분석결과 각각의 법안 및 조례들 지역신문 지원정책의 필요성은 공유하고 있지만, 지원방식과 지원대상. 예산조달 및 운용, 위원회의 위상 등에서 상이한 점들이 발견되었다. 이러한 내용들을 바탕으로 본 연구는 성과와 효율성, 지속성의 측면에서 각각의 법안들이 공유해야 할 내용들을 대안으로 제시하였다.
Abstract
Currently, local newspapers in korea are losing the ability to propagate due to weakened competitiveness and centralized market structure of major daily newspapers. Central government enacted 'Special Act on Supporting Development of Local Newspapers' in 2004 to establish support policy on local newspapers, and local autonomous entities are also enacting 'Ordinance on Supporting Development of Local Newspapers' since 2010. However, support policies on local newspapers are limited to temporary support. Also, details are in conflict with each other, causing various problems. Under these circumstances, this research tried to grasp the characteristics by comparative analysis of articles in local newspaper development support policies. In specific, this research drew changing shape of support policies by analyzing articles, enforcement ordinance, and revised result of Special Act on Supporting Development of Local Newspapers. Also, this paper compared enactment basis of the Special Act on Supporting Development of Local Newspapers, including Registration, etc. of Periodicals Act, Act on the Guarantee of Freedom and Functions of Newspapers, etc, and Act on Promotion of Periodicals, Including Magazines. Finally, this paper attempted to find characteristics and differences by analyzing ordinances on supporting development of local Newspapers which are enacted after enforcement ordinance of the Special Act on Supporting Development of Local Newspapers. Analysis results revealed that each bills and ordinances share necessity of supporting policies on local newspapers. However, differences were found in ways of supporting, support targets, procuring and managing budgets, status of committee, and etc. Based on these results, this study suggested details that each bills should share in the aspect of outcome, efficiency, and durability as alternative ways.
