교도소 정신장애 수용자처우 관련법의한계 및 개정방향에 관한 연구

이 연구의 목적은 교도소 정신장애 수용자 치료 및 처우개선을 위하여 유엔의 피구금자최저기준규칙, 유엔 정신질환자 보호 및 정신건강 관리 개선을 위한 원칙, 그리고 유럽교도소규칙 등의 국제규범상 정신장애 수용자처우 규정과 현행 형의 집행및 수용자 처우에 관한 법률, 치료감호 등에 법률 등의 관련 규정을 비교하여 관련문제점을 살펴보고, 그 입법적 정비방향을 제시하는데 목적을 두었다. 이러한 연구는 궁극적으로 정신장애자에 의한 범죄감소와 정신장애 수용자에 대한처우개선, 그리고 인권강화에 기여할 것이다. 연구 결과 현행법의 가장 큰 문제점은 국제규범이 권고하는 것과는 달리 정신과전문치료시설이나 전문의료진의 필요적 배치규정, 외부 민간시설 등과의 필수적 협력관계 규정, 정신장애 수용자에 대한 특별한 처우 프로그램의 명문규정, 일일관찰 및보고규정 등이 미비한 것으로 나타났다. 이와 같은 문제점을 해결하고, 국제규범의 권고를 수용하기 위해서 다음과 같이현행법의 개정방향을 제시하였다. 첫째, 정신장애 수용자 치료시설 및 전문의료진 배치에 대한 명확한 규정을 두어야 한다. 둘째, 수용자의 정신장애 여부에 대한 진단규정을 명문화하여야 한다. 셋째, 국가의료체계와의 협력 및 민간의료기관과의 필수적협력체계를 명문화하여야 한다. 넷째, 정신장애 수용자에 대한 치료보고 및 특별프로그램 운영 규정을 두어야 한다. 다섯째, 교정시설에서 석방된 정신장애 수용자에 대한 치료규정을 마련해야 한다. 여섯째, 형의 집행 및 수용자의 처우에 관한 법률상 정신장애 수용자 의료규정을 국제규범 수준에 맞게 전반적으로 보완하여야 한다. 일곱째, 치료감호처분 등에 관한법률의 정신장애 수용자 의료규정을 국제규범 수준에 맞게 정비하고, 특히 교정시설에서 이송된 정신장애자에 대한 치료 및 처우규정을 명확히 하여야 한다.
Abstract
The purpose of this study is to compare the differences of mentally disabled prisoners in correctional system between the UN standard minimum rules for the treatment of prisoners, the UN principles for the protection of persons with mental illness and the improvement of mental health care, European standard minimum rules for the treatment of prisoners and the correctional related korean law such as administration and treatment of correctional institution inmates act, medical treatment and custody act and to find out the problems of the Korean laws and to suggest improvement directions. This study will ultimately contribute to reducing the mentally disabled crimes, improvement of the correctional treatment and the strengthening of human rights mentally disabled prisoners. As a result of this study, the revised direction of the korean current correctional law is suggested as follows First, the korean current correctional law clarify regulations for the placement of special medical facilities and psychiatric specialists for mental illness offenders. Second, the korean current correctional law should stipulate the rules for the diagnosis of mental disorders of prisoners. Third, the korean current correctional law should stipulate the essential cooperation system with national medical system and private medical institutions. Fourth, the korean current correctional law should clarify the treatment report and the regulations on the operation of special treatment programs on the mentally disabled prisoners. Fifth, the korean current correctional law should provide the treatment for the psychiatric inmates released from the correctional institution. Sixth, administration and treatment of correctional institution inmates act should complement the medical regulations of the mentally disabled prisoners in accordance with the international norms. Seventh, medical treatment and custody act should improve the medical regulations of prisoners with mental disorders according to the international norms, and clarify the treatment and treatment of psychiatric inmates who have been transferred from the correctional institution.
