한반도대운하건설 구상에 있어 공법적 쟁점에 관한 시론적 고찰

Abstract

The project of The Korean Peninsula Carnal is being taken shape. But The project cannot be realized with only validity of business, but it needs regal estimates by the sense of planning law. That is to say, the purpose of this project must be justified and must have good coordination with system of The National Land Planning And Utilization Act. In concrete plans for the project and estimates for the plans, and, All of interests related this project must be adjusted through the fair comparison of interests between public interests and private interests. If one of these is failed, the project will be unconstitutional and illegal. So, The government should investigate and compare all of interests related to the project by the sense of planning law. So, The government should prove the legitimacy that interests to be gained from constructing of The Korean Peninsula Carnal can impress all other interests through investigating and comparing all of interests related to the project by the sense of planning law.
