Abstract
The public lending right (hereinafter “the right”) is defined as a right granted to authors to receive payment for the free lending of their books owing to the free public access to their books in public libraries. The right exists in many European countries, although it varies in its application from country to country. However, the United States does not legally recognize the right because it is in conflict with the first sale doctrine which is incorporated into the U.S. copyright law. Even though the right system does not operated in Korea, some kinds of opinions have been expressed about whether it might be introduced to Korea in the future. From the standpoint of law and economics, this Study examines whether free lending of a book in public libraries decreases the author’s income. The results of this Study are as follows: Firstly, since the publisher with copyright determines single monopoly price of his publication and there is deadweight loss which causes social costs, the introduction of the right might work as a heavy burden on people. Secondly, the high frequency of lending a specific book might increase the sale of the book as long as it has an impressive promotional effect. Thirdly, as the number and frequency of lending a book increases, the author’s income might also be increased because the author will get earnings from media appearances, public lecture, and filming of the book.
