자격기본법의 입법론적 개선방안

Abstract

The Framework Act on Qualifications has functional limitations in the sense that it is incapable performing such functions of a fundamental law as the presentation of directions for promotion of qualification policies, overall and comprehensive systematization of qualification systems and policies, securement of continuance and consistency of qualification policies, functions for diffusing messages on qualification policies to the people. Hence, it is urgently required to reinforce the characteristics of the Framework Act on Qualifications as a fundamental law enacted for the systematic and efficient implementation of qualification policies and the functions thereof, by reinforcing the connectivity of qualification systems and related legislative systems. This study finds out, in this respect, points in question by analysing legislation history and system of the Framework Act on Qualifications and proposes methods of systematic and content-related modifications for the reinforcement of the characteristics of the same Act as a fundamental law and the functions thereof. It proposes, to be specific, methods for systematic management and administration of qualifications, methods for improving the unity and consistency of terminology as well as methods for modifying the contents of the same Act such as application for or revocation of accreditation.
