지속가능한 도로의 이용과 공유 전동킥보드를 위한 법적 과제

이제 도시 내에서 전동킥보드를 흔히 발견할 수 있다. 공유 전동킥보드는 공유 플랫폼을 통해 단거리 이동에 이용되는 새로운 유형의 이동수단이다. 이론적으로 공유 전동킥보드는 도시 내 교통의격차를 줄이고 교통체증이 심한 도시에서 더 용이하게 이동할 수 있도록 하고 자가용이나 택시 등의개인용 차량보다 더 저렴하고 환경친화적인 대안을 제공할 수 있는 이동수단이다. 그런데 오늘날공유 전동킥보드에 대해 많은 문제점들이 제기되고 있다. 그 대부분은 안전에 관한 것이다. 전동킥보드는 자전거도로 이동이 원칙이지만 우리나라는 대부분의 도로가 자전거와 보행자의 겸용도로이기 때문에 보행자들로서는 안전에 대한 우려가 클 수 밖에 없다. 「도로교통법」은 운전을 위한 자격요건, 안전한 운행과 보행자 보호를 위해 준수해야 할 운전자의 의무, 위반행위에 대한 처벌규정 등을 마련해두고 있다. 그럼에도 불구하고 무면허운전, 안전모미착용, 보도운행, 음주운전, 승차정원초과 등과 같은 위법행위가 곳곳에서 이루어지고 있다. 전동킥보드에 대한 규제가 효과적으로 이루어지지 않는 것은 현재의 관련 법제가 공유 전동킥보드의 특성을 반영하고 있지 못하는 데 중요한 원인이 있다. 공유 전동킥보드가 현대 도시가 가지는 많은 문제점들 즉, 교통혼잡과 대기오염의 증가, 사회·경제적 불평등의 심화 등을 해소하기 위한 지속가능한 교통수단의 하나로 기능하기 위해서는 공유 전동킥보드의 특성을 반영할 수 있는 법제가 마련되어야 하고 구체적으로 공유 전동킥보드 사업자에 대한 규제근거의 마련, 환경적 지속가능성 확보를위한 기준 마련, 사회적 형평성을 위한 규정 마련 등과 같은 법제도적 개선이 필요하다.
Abstract
In recent years, e-kickboard have become a familiar sight in cities. Sharing-typee-kickboard is an innovative urban transport solution aimed at providing short-distancetravel options through sharing platforms. The appeal of e-kickboard is that it providesequitable, accessible, sustainable, cost-effective transport alternative. However, manyproblems have surfaced with sharing-type electric kickbords. Most of the problems arerelated to safety. According to the Road Traffic Act, electric kickboards must travel on bicycleroads just like bicycles. By the way, most bicycle roads are shared by bicycles andpedestrians in South Korea. For this reason, many pedestrians are concerned about usingthe sidewalks jointly with electric kickboards. The Road Traffic Act establishes requirements for driver qualifications, the duties ofdrivers to ensure safe operation and protect pedestrians, and penalties for violations. Nevertheless, illegal activities such as driving without a license, failure to wear safetyhelmets, riding on sidewalks, drunk driving, and exceeding passenger capacity continue tooccur frequently. Falling to properly regurate electric kickboards is a significant issue, mainlybecause current legislation does not adequately reflect the hybrid characteristics of sharedelectric kickboards. In order to secure the role of electric kickboards as an alternative meansof transportation, that addresses the many problems faced by modern cities, such as trafficcongestion, increased air pollution, and exacerbated social and economic inequalities,legislative improvements are necessary. They should include (1) establishing regulatorygrounds for shared electric kickboard operators (2) establishing criteria for environmentalsustainability (3) creating regulations to promote social equity.
