대북전단 살포행위 제한에 관한 소고 - 접경지역 주민 보호의 필요성 중심으로 -

헌법재판소가 대북전단 살포행위를 금지하고 위반시 형사처벌 하는 「남북관계 발전에 관한 법률」 규정에 대해 표현의 자유 침해를 이유로 위헌 결정을 내린 이후 대북전단 살포행위가 빈번하게 발생하게 되었고, 이에 대한 대응으로 인해 북한에서 대남오물풍선 살포 및 대남확성기 소음을 확대함으로써 그 피해는 고스란히 접경지역 주민들이 받게 되는 상황이 되었다. 그런데 접경지역 주민들은 짐승 울음소리, 귀신소리, 사이렌소리 등 밤낮으로 울리는 괴기스러운 대남확성기 소음으로 인해 건강에 큰 위협을 받고 있는 등 생명 및 일상을 위협할 정도의 피해를 입고 있다. 이에 접경지역 거주 주민들의 악화된 생활을 개선할 수 있는 현실적이고 직접적인 방법이 있다면 그러한 조치를 우선 취하여야 할 필요성이 있는바, 이러한 필요성의 관점에서 현행법을 통해 대북전단 살포행위를 제한할 필요가 있다. 이와 함께 법률 개정을 통해 대북전단 살포행위를 일률적으로 제한하는 것이 넓게는 우리나라 전체의 평화 분위기 조성을, 좁게는 접경지역 주민들의 일상을 회복시켜 줄 수 있는 실효적인 방안이라 할 것이다.
Abstract
Since the Constitutional Court ruled that the provisions of the Act on the Development of Inter-Korean Relations, which prohibits spraying leaflets and criminally punishes violations, are unconstitutional due to infringement of freedom of expression, spraying leaflets have become a frequent occurrence, and in response, North Korea has expanded its filth balloons and loudspeaker noise, which has led to a situation in which the residents of the border area are the ones who bear the brunt of the damage. However, the residents of the border area are suffering from life-threatening damage to their health and daily lives due to the bizarre noise of the loudspeakers, which sound like animal cries, ghosts, sirens, and other sounds day and night. Therefore, if there is a realistic and direct way to improve the deteriorated lives of the residents of the border area, it is necessary to take such measures first, and in view of this necessity, it is necessary to restrict leaflet spraying to North Korea through the current law. At the same time, it is an effective way to create a peaceful atmosphere for the entire country and, narrowly, restore the daily lives of the residents of the border area by uniformly restricting leaflet spraying to North Korea through the revision of the law.
