Abstract

The online platforms are not confined solely to e-commerce but extends across diverse domains including artificial intelligence (AI), semiconductors, digital healthcare, and mobility. Given the complexities of the platform markets, any regulatory intervention must be approached with objetive evidence rather than speculative theories. In December 2023, the Korean Fair Trade Commission(KFTC) announced that it would make the so-called “Platform Competition Promotion Act” (PCPA) based on the so-called “tipping effect”, which disregards the rule of reason in competition law. Under the PCPA, the KFTC may condemn certain practices, such as the so-called “self-preferencing”, without requiring proof of anticompetitive effects. Regrettably, the KFTC appears to rely excessively on speculative theories on platform monopolies. Despite its name, the PCPA may distort platform competition. The KFTC should deal with issues of platform monopolies with real-world evidence under the rule of reason rather than the dubious tipping theory. Otherwise, developments in not only platform but also related areas such as AI, digital healthcare, and mobility would be impaired by the KFTC’s misguided regulation.
