유형적 연계성과 동아시아 후기공산사회들을 통해서 본 북한의 정치변동과 전환기 정의

Political Change and Transitional Justice in North Korea: From the Perspective of Typical Connectivity and East Asian Late-Communist Societies

초록

북한의 현 체제가 “대규모의 체계적이고 지속적인 인권침해”에 기반을 두며 유지되고 있지만, 독재체제의 다양한 위기지수들과 붕괴요인들에 따르면 지속적인 위기에 처해있다. 김정은의 고위간부들에 대한 빈번히 숙청과 잔혹한 처형은 그에 대한 궁정 쿠데타를 유발할 가능성이 충분히 있다. 따라서 통일에 초점을 두며 북한의 급격/완만한 정치변동에 대한 대비가 절실히 필요하다. 통일 한국사회의 정통성과 정체성 확립을 위해 “전환기 정의”는 그 대비책의 필수적인 구성요소가 될 것이다. 본 연구는 전환기 정의와 권력승계 과정에 대한 유형론적 접근들을 활용하여 북한에서의 전환기 정의 구현 가능성과 제약요인들을 평가해 보았다. 준거로서 몽골, 중국, 베트남에서 경험한 사회‧정치적 변동과 정의 조치들을 후기공산주의사회에서의 이분법적 분화에 대한 E. 핸키스(Elemér Hankiss)의 연구와 중·동부유럽 시민사회의 특성과 3단계에 걸친 형성·발전에 대한 M. 캘더(Mary Kaldor)와 M. 하라스치(Miklos Haraszti)의 연구들에 근거하여 검토하였다. 최종적으로 T. 리세(Thomas Risse) 등의 “나선형 5단계론”에 따라 북한의 인권개선 전략과 전환기 정의 대책을 제안하였다.

Abstract

The current regime in North Korea is sustained on the basis of “gross, systematic, and persistent infringements of human rights,” yet it also remains in constant peril according to various crisis criteria and collapse elements for dictatorial regimes. The frequent purges and brutal executions of high-ranking leaders by Kim Jung-un could easily rebound in a palace-coup against him. Therefore, preparations for radical and gradual political change in North Korea are urgently needed, including a focus on the national reunification of Korea. “Transitional justice” will be one essential component for establishing the legitimacy and identity of a unified Korean society. Therefore, this study evaluates the possibility and constraints of political change and transitional justice in North Korea using typological approaches to transitional justice and power succession. As reference, the socio-political changes and justice measures experienced in Mongolia, China, and Vietnam will be examined, relying on the research by E. Hankiss on dichotomous differentiation in late-communist societies and the studies of M. Kaldor and M. Haraszti on the characteristics of civil society and its three-phased formation and development in Central and East Europe. Finally, strategies to improve North Korean human rights and preparations for transitional justice are proposed based on the “five-phase spiral model” of T. Risse et al.
