우리나라의 보육업무는 지방정부의 법인위탁과 개인 직영의 보육이 일반적이다. 그러나 보육시설의안전은 관계법령에 의하여 점검에 그치고 있다. 그 만큼 시설물 구조에 대한 법적 지식은 관계 전문가에 의존하고 있어 위기 시 대응력이 떨어진다고 해도 가언이 아닐 것이다. 어린이집은 안전취약물시설에 해당 된다. 취약시설을 사용하는 사용자는 안전에 대한 기본적인 교육이 부족한 아동과 노인 및 장애인이거나, 계속적인 시설물의 구조변경이나 증설로 인해 시설물 자체의 안전을 보장하지 못하는 시설물을 안전취약시설물이라고 정의한다. 이 법령에 의하여 어린이집 그리고 유치원은 연간 안전점검계획을 수립한 후, 자체적으로 정기 또는 수시 안전점검을 실시하되, 실내 환경과 시설ㆍ설비 및 비품ㆍ교구에 대해서는 매일 점검하고 기록ㆍ관리해야 한다. 따라서 본연구자는 보육시설 안전관련 법적 검토와사고 시 적용 공법과 민법에 대하여 고찰하였다. 또한 보육시설의 설치와 내외부 시설 관련 법적 기준,안전사고 배상에 따른 법적연구를 하였다.
Abstract
It is common for local government entity entrusted with the care of the nation’s personal carebusiness is direct. But by the laws cease to check the safety of the child care facility. That muchdepends on the relationship expert legal knowledge of the facility’s structure is less responsiveduring the crisis. Childcare facilities are available for the safety of vulnerable water. Basic safetytraining for children and the elderly, and the disabled or poor, vulnerable facilities, safety isdefined as a facility does not ensure the safety of the facility itself, due to the changing structureof the facility, or continuing to use the expanded user facilities are vulnerable. And was carriedout with regular or occasional safety checks on its own, and should be checked daily by a decreeestablishing an annual day care kindergarten after safety inspection plan for the indoor environmentand facilities, equipment and fixtures, parish records and management. Therefore, we investigatedthe safety-related child care and legal review process and applicable civil law at the accidentinvestigator. Also, according to the legal research and accident compensation installation of childcare facilities and outside legal standards.
