본 논문에서는 토지의 공용수용과 관련된 정당보상의 개념을 문헌적으로 검토하였고, 이에 근거하여 현재 문제가 되고 있는 우리나라의 공용수용에 대한 보상액과 시장가치의 괴리도를 분석하였다. 본 연구는 분석을 위하여 헤도닉 모형을 이용하였으며 경남지역의 170개 표본이 사용되었다. 우리나라의 보상가격이 시장가치의 어느 수준 정도인가를 분석하기 위해서 시장가치 추정모형을 이용하여 대상지역 별 및 지목별로 비교 분석한 결과, 대부분의 경우 보상가격이 시장가치 수준보다 다소 높은 것으로 나타나, 과잉보상의 모럴헤저드나 과소보상의 불공정이 상대적으로 적은 것으로 나타났다. 이는 공용수용에 대한 보상가격 설정 시, 법률적으로나, 다양한 개별요인, 거래사례, 호가 등을 고려하는 협상당사자들의 노력의 반영으로 분석 된다
Abstract
This paper reviewed the literatures on the just compensation for public acceptance of land. Through this, we analyze the differences between compensation value of public acceptance and market value, which is one of major issue in public project design. To estimate market price, we use "Hedonic Model" and compare this price with real compensation data from 170 cases of Kyung-nam prefecture, in Korea. In most areas and different land use categories, the results of empirical estimation show that Hedonic model compensation price is slightly higher than the market price.
