필리핀과 한국 토지개혁법령의 특징 (1955년~1988년) : 토지개혁의 유형 및 필리핀 실패의 근본 원인

초록

본고는 한국과의 비교를 통해 필리핀 토지개혁법령의 특징과 그 법령에 나타난 토지개혁의 유형을 파악하여 그 실패의 기본 요인을 찾아내고자 했다. 첫째, 필리핀 토지개혁법은 1955년 이후 1972년의 법령까지 기존 지주의 토지소유 상한, 사유농지 매수 및 수용를 위한 협상 방법과 착수 조건, 토지개혁구의 설치, 농지의 매수우선권에 대한 제한 등의 면에서 점진적으로 개선되었다. 둘째, 양국은 유상몰수⋅유상분배라는 점에서 공통적이지만, 토지개혁 정책의 실시방법에서는 전혀 다른 유형이다. 즉 필리핀은 정책 시행 전기간 동안 분익소작농의 정액소작농화의 1단계 및 자작농 전환의 2단계 정책을 유지하였다. 필리핀 토지개혁법의 이러한 자작농-정액소작농병존형은 토지개혁의 본질에서 크게 벗어난 것이다. 셋째, 필리핀 토지개혁 실패의 가장 중요한 원인의 하나로 많은 연구자들이 재정・금융지원의 부족을 지적하지만, 한국의 농지개혁법에는 이와같은 농민에 대한 지원정책이 전혀 없음에도 성공적이었다. 오히려 느슨한 개혁법령으로 인한 높은 매수가격이 필리핀이 실패하게 된 보다 중요한 이유였다. 필리핀 토지개혁의 완만성과 실패의 근본 원인은 지주계급의 반발로 인하여 토지개혁법령에 경자유전의 원칙을 철저하게 적용하지 못했기 때문이다.

Abstract

The purpose of this study is to find out the characteristics of the Philippine land reform acts and the main reasons of its failure, by comparing her acts with the agricultural reform act of Korea, during the period from the 1950s to 1988. First, the land reform acts in the Philippines has been improved gradually for peasants, from the first land reform act of 1955 to the last decree of 1972, with respect to the limits of the size of the agricultural land owned by landlords, the manner and the condition of negotiation for purchasing land, establishment of the land reform district, lessee's right of pre-emption, ects. Second, in implementing land reform policies, the Philippine ways was more unfavorable to the peasants than those of Korea. Third, the principle that only cultivators own the land had not been vigorously adopted to the land reform acts. That is the most important cause of the failure of land reforms in the Philippines.
