Abstract

The effective feminist legal education is to incorporate feminist legal theory into legal practice, which improves theory-practice synergy. The domestic violence legal clinic in America is the best forum for both feminist legal theory and practice because the methods and goal of the clinic is feminist. In general, the goal of domestic violence clinic is to empower the battered women and to raise student's consciousness through experiences of both client and student with sensitivity about oppression. The feminist legal methods are realized in domestic violence clinic as the student's empirical lawyering through client's story, narrative feedback, case theory with women's questions and contextual reasoning, alleviation of hierarchical lawyer-client relationship, consensual decision-making in client-centered lawyering, and cooperative interdisciplinary learning by extension of context. The students who participate in the domestic violence clinical program of Northeastern University School of Law listen to the battered women clients and critically perceive problems of legal system about the battered women through the clients' experiences. The students solve the problems for client after understanding the client's context by the circular learning of experience, reflection, analysis and strategizing. Furthermore, Northeastern law school expands the domestic violence clinical program to the first year students who are not allowed to practice before the court, connecting with upper level programs. Northeastern educates all participants on feminist legal methods in clinical education and training and establishes the Domestic Violence Institute as a think-tank to provide more systematic legal service. Korean feminist legal education needs more effective educational methods ahead of 2009's opening of Korean law school. The feminist legal methods with lawyering or legal advocacy such as one of Northeastern domestic violence clinical program will enhance women's empowerment in practice, conducive to Korean feminist legal education.
