초록

오늘날 기술매개 성폭력 논의에서는 피해 유형과 이를 포괄할 수 있는 법·제도 관련 논의에 비해 그 속성에 따른 피해 및 고통에 관한 논의는 아직 충분하지 않다. 본 연구는 이 같은 문제의식으로부터 출발, 현행 기술매개 성폭력에서의 판단기준인 ‘음란성’ 에 대한 재고와 기술매개성에 대한 정치한 이해 없이는 기술매개 성폭력의 피해와 고통이 제대로 포착되기 어렵다고 주장한다. 대표적으로 여성의 이미지나 개인정보의 강탈 및 유포 등은 가해 행위의 그 성애적 목적에도 불구하고 성폭력으로 이해되고 있지 못하다. 현행법상 음란성 기준에 준해 판별함에 따라 ‘성폭력’이 아니라 모욕이나 명예 훼손 등으로 범주화되어 젠더기반 폭력으로서 성폭력의 의미와 그 효과가 간과되고 있는 기술매개 성폭력 상담 사례를 분석한다. 해당 사례 분석을 통해 기술매개 성폭력에 대한 이론적, 법ㆍ제도적 논의가 전통적 성폭력 개념에 준하기보다 기술매개성으로 인한 피해와 고통의 속성을 고려하는 방향으로 옮겨가야 할 필요성에 대해 논한다. 기술 매개 성폭력은 전통적인 성폭력과는 다른 특성을 지니는 동시에 이 피해는 신체적, 정신적 모두에 실질적인 영향을 미치고 있기 때문이다. 기술매개 성폭력의 해악은 ‘음란성’에 있는 것이 아니라 개인정보를 성애화한 수단화가 그 핵심에 있음을 논한다. 기술 매개 성폭력은 기술매개적 속성에 따라 피해자가 구축한 일상과 사회적 관계를 침해당하고 성적으로 통제된다는 점, 또한 피해가 종료되지 않고 이어진다는 점, 피해 이후는 물론 피해의 가능성으로 인해 ‘불안’, ‘공포’와 같은 심리 상태가 지속되는 등의 ‘실질적’인 피해를 드러내고자 한다.

Abstract

This study argues that it is difficult to adequately capture the damage and pain of technology-facilitated sexual violence without complete reconsidering the standard of 'obscenity', which technology-mediated violence is now judged by. For example, the extortion and dissemination of images of women or personal information are not understood as sexual violence despite its sexual purpose. This study analyzes cases of technology-facilitated sexual violence in which the meaning and effect of gender-based sexual violence are overlooked because they are categorized as insults or defamation rather than ‘sexual violence’ according to obscenity standards under the current law. In regard of theoretical, legal, and institutional discussion of technology-mediated sexual violence through victim counseling case analysis, there is the need to move our standpoint to a direction that considers the nature of damage and suffering caused by technology rather than the traditional concept of sexual violence. This is because technology-facilitated sexual violence has different characteristics from traditional sexual violence, and at the same time, the damage has a real impact on both physical and mental health. It is argued that the harm of technology-facilitated sexual violence is not in 'obscenity', but in the sexualization of personal information. Due to the technology-mediated nature of violence, the daily life and social relationships established by the victim are violated and sexually controlled.
