Abstract

Anti-doping programs are grounded in the intrinsic value of sports, which is often referred to as “the spirit of sport.” This encompasses the ethical pursuit of human excellence through dedicated perfection of each athlete's natural talent. Anti-doping is crucial for upholding integrity and fairness in sports. The Court of Arbitration for Sport (CAS) has rendered numerous awards, which have contributed to the development of the duty of care theory, outlining the responsibilities of athletes in preventing doping. To determine the level of fault in a particular case, it is helpful to consider both the objective and subjective elements. The objective element refers to the standard of care that a reasonable person would be expected to follow in the athlete's situation. The subjective element pertains to the level of care that could reasonably be expected from the athlete given their personal capabilities. In terms of the objective element, athletes can take several measures to prevent doping, such as reading the label of the product used, cross-checking all ingredients against the list of prohibited substances, conducting an internet search of the product, ensuring the product is reliably sourced, and consulting appropriate experts before consuming the product. Determining the appropriate level of care for a specific athlete under particular circumstances can be challenging. The current anti-doping program operates under the principle of strict liability and imposes a comprehensive duty on athletes to prevent doping. While this approach is effective in achieving the anti-doping program's objectives, it may be inadequate for safeguarding athletes' fundamental rights. Striking a balance between these competing interests is necessary in designing an effective anti-doping program.
