2022년 체육인복지법이 제정⋅시행되었다. 이 법률은 체육인에 대한 복지정책의 수립과 체육인복지를 위한 제도적 기반을 마련하여 체육인들의 생활안정과 체육활동의 증진에 이바지함을 목적으로 하고 있다. 이 법률에서 체육인은 국민체육진흥법상 선수, 체육지도자, 경기단체에 등록된 심판 등이다. 이렇게 국가의 실정법인 체육인복지법은 복지의 대상을 국민체육진흥법상 체육인을 중심으로 규정하고 있다. 그런데 스포츠기본법에서는 스포츠를 체육의 상위개념으로 규정하고 있다. 그래서 스포츠인과 체육인도 그 범위가 같은지 의문을 가지게 된다. 스포츠기본법은 체육에 있어서 기본법이기 때문에 스포츠와 체육에 대하여 보다 명확한 개념 정의가 필요하다. 이 문제는 체육인복지법에서도 중요한 의미를 갖는다. 그 이유는 국가의 실정법은 체계정합성 원칙에 따라 일정한 기준과 내용을 가져야 한다. 그렇지 않으면 법해석에 혼란을 초래하면서 그 법률의 적용 대상인 국민에게 피해를 줄 수 있다. 체육인복지는 법체계에서 보면 스포츠인의 복지를 의미하므로 스포츠와 관련하여 직업으로서 스포츠활동을 한 사람은 직⋅간접적으로 해당한다고 보아야 할 것이다. 현행 체육인복지법은 체육인의 지위를 보장하는 규정과 함께 체육인을 지원하는 제도들에 대하여 규정하고 있다. 체육인복지법의 핵심은 체육인의 지원이라고 할 수 있는데, 체육유공자의 지정과 보상, 국가대표 선수와 지도자에[ 대한 지원, 선수 등의 보호를 위한 보험제도와 공제, 장학사업, 원로 체육인의 지원, 체육인의 진로 지원과 창업 지원 및 자금의 대여 등이다. 그 외에 업무상 재해에 대한 보호, 협동조합에 대한 지원 등이다. 이런 지원제도 등이 체육인복지에 얼마나 현실적으로 기여하고 있는지 제한적이라 할 수 있다. 체육인복지를 위하여 특히 체육인의 생활안정을 위해서는 무엇보다도 체육기금의 조성을 통한 지원혜택을 늘이는 것이 필요하다. 이를 위해서는 이미 여러 분야에서 실시하고 있는 공제회제도도 고려해야 한다. 현행 체육인복지법에는 공제제도에 대하여 매우 제한적으로 규정하고 있다. 그런데 체육인의 복지에서는 무엇보다도 공제회제도를 활성화하는 것이 실질적으로 도움이 될 수 있다고 본다. 그런 점에서 체육인복지법의 개정이 필요하고, 공제제도를 구체화하여 체육인복지를 실질화해야 한다.
Abstract
In 2022, the Sportsperson Welfare Act was enacted and enforced. The purpose of this Act is to contribute to the stabilization of the lives of athletes and the promotion of sports activities by establishing welfare policies for athletes and establishing an institutional basis for the welfare of sportsperson. In this law, sportsperson are players, sports instructors, and referees registered with sports organizations under the National Sports Promotion Act. In this way, the Sportsperson Welfare Act, a national law, regulates the welfare target centered on the athlete under the National Sports Promotion Act. However, in the Sports Basic Law, sports is considered as a superordinate concept of physical education. So, sportsmen and athletes question whether the range is the same. Since the Sports Basic Act is the basic law in physical education, it is necessary to define more clearly the concept of sports and physical education. This issue also has an important meaning in the Sportsperson Welfare Act. The reason is that the national law must have certain standards and contents according to the system consistency principle. Otherwise, it may cause confusion in the interpretation of the law and harm the people who are subject to the law. Since the welfare of sportsperson means the welfare of sports people in the legal system, it should be seen that those who engage in sports activities as a job in relation to sports are directly or indirectly applicable. The current Sportsperson Welfare Act stipulates the systems to support athletes along with the regulations to guarantee the status of athletes. The core of the Sportsperson Welfare Act can be said to be support for athletes, such as designation and compensation for athletes of merit, support for national players and coaches, insurance system and deduction for the protection of athletes, scholarships, support for senior athletes, athletes career support, start-up support, and loans of funds. In addition, protection against occupational accidents and support for cooperatives are provided. It can be said that these support systems are limited in how much they actually contribute to the welfare of sportsperson. For the welfare of athletes, especially for the stability of life of athletes, it is necessary to increase support benefits through the creation of sports funds. To this end, it is necessary to consider the mutual aid association system that has already been implemented in various fields. The current Sports Persons Welfare Act has very limited regulations on the deduction system. However, in terms of the welfare of sportsperson, it seems that activating the mutual aid association system can be of practical help. In this respect, it is necessary to revise the Athlete Welfare Act, and to materialize the mutual aid system to make the welfare of sportsperson practical.
