도로교통법령은 운전면허를 제1종 운전면허, 제2종 운전면허 등 여러 종류의 운전면허로 나누어 규정하고 있다. 대법원은 이러한 여러 종류의 운전면허를 각각 별개의 면허로 취급하고 있다. 즉 자동차 운전면허를 취득할 때뿐만 아니라 운전면허를 취소, 정지할 때도 서로 별개의 것으로 취급하여, 취소, 정지 사유가 발생한 해당 운전면허에 대하여만 취소, 정지를 인정하고 있다. 다만, 예외적으로 운전면허의 취소, 정지 사유가 특정의 면허에 관한 것이 아니고 다른 면허에 공통된 것이거나 운전면허를 받은 사람에 관한 것일 경우에는 여러 운전면허 전부를 취소, 정지할 수 있다고 한다. 대법원이 다른 운전면허에 공통되어 함께 취소, 정지할 수 있는 운전면허로 드는 것은 위반 행위 시 운전한 차량을 운전할 수 있는 다른 운전면허와 취소되는 면허의 부분집합이 되는 다른 운전면허이다. 운전면허 취소 사유 중 운전면허를 받은 사람에 관한 사유가 어떤 것인지는 판례상 명백하지 않다. 음주운전, 치상 후 도주, 벌점 초과의 사유가 운전면허를 받은 사람에 관한 사유가 아니라는 취지의 판례는 있다. 대상 판결은 도로교통법이 운전면허의 필요적 취소 사유로 들고 있는 차량 절취의 사유가 운전면허를 받은 사람에 관한 사유로서 운전면허 전부를 취소할 수 있는지에 관한 것이다. 이 판결에서 대법원은 차량절취가 여러 종류의 운전면허를 모두 취소할 수 있는 사람에 관한 사유에 해당하지 않는다는 점을 명확히 하였다.
Abstract
Road Traffic Act rules many kinds of driving license, class 1 driving license, class 2 driving license, etc. The Supreme Court takes each driving license as different types. When not only issuing driving license but also canceling or suspending driving license, Supreme Court admits canceling or suspending only the driving license that reasons for cancellation or suspension occur in. However exceptionally in case that reasons for cancellation or suspension are common to other driving licenses or occur in the driver himself, all driving licenses are cancelled or suspended. Driving licenses that reasons for cancellation or suspension are common to are those driving licenses to be able to drive violation vehicles with and partial licenses of canceled license. But it is not clear on precedent what is reasons for cancellation or suspension occurring in the driver. Target judgment is whether vehicle theft is reasons for cancellation occurring in the driver or not. In this judgment Supreme court has clarified that vehicle theft is not the reason for cancellation occurring in the driver.
