21년만에 제안된 법무부의 상법개정안은 손해방지와 관련하여 그 범위와 의무위반의 효과 그리고 손해방지비용의 보상범위에 대하여 획기적인 내용을 담고 있다. 손해방지의무의 범위를 고의중과실로 한정하고, 그 위반의 경우에 고의의 경우에는 면책으로 하고 중과실인 경우에는 이행하였더라면 방지하거나 경감하였을 손해를 감액하며, 현행상법상 무한으로 손해방지비용을 보상하도록 하고 있는 것을 보험자의 지시가 있는 경우에 한정하여 무한보상을 허용하고 있다. 이 글은 손해방지의무의 범위와 그 위반의 효과, 그리고 손해방지비용의 보상범위에 관하여 비교법적으로 검토하고 상법개정안 제680조를 점검하는 것을 내용으로 한다. 구체적로는 고의 또는 중과실을 분리하지 않고 위반의 효과에 대하여도 방지 또는 경감할 수 있었던 손해액을 감액하도록 하며, 손해방지비용의 보상의 경우 보험자의 지시를 받지 못할 급박한 사정이 있는 경우에는 보험금액을 초과하여 보상을 받을 수 있도록 하는 것을 제안하고 있다.
Abstract
The ministry of justice has recently presented the 2007 revised bill of insurance contract act which contains the overall changes on the duty of the insures to mitigate insured loss. The bill restricts the scope of the duty to the insured's intentional harm and gross negligence. And when he violates intentionally it, the insurers are discharged form the liabilities. But whereas he does so by his gross negligence, they may claim the damages which would be defended or mitigated if he performed his duties. This paper purposes to study the extent of the duty to mitigate insured loss, the effect of the failure to perform that duty. I will review it by investigating the insurance law under the major nations' legal systems. Finally, when the insureds violates the duty, I think the effect of it must be same between insured's intentional harm and gross negligence. And I proposes that if the insureds cannot get the insurer's directions, the insurers must pay all the costs to mitigate the loss beyond the insured amount.
