본 연구는 현행 대학입학제도 관련 법규가 어떻게 구조화되어 있으며 이러한 법규가 대입정책관련 이해집단에게 어떠한 영향을 미치고 있는지를 파악하고자 하였다. 본 연구에서는 대학입학제도와 관련된 주요한 문제들, (1) 학생들이 시험 성적 향상을 위해 무한 경쟁하는 것, (2) 고등학교가 본래의 교육과정 운영보다는 대학입시에 종속되어 운영되는 것, (3) 대학이 건학이념이나 학문영역별 적격자를 선발하는 데에 자율성이 부족한 것의 원인을 교육외적 변인이 아니라 교육제도 내에서 찾고자 시도하였다. 초등학교·중학교·고등학교 학교생활기록부전산처리 및 관리지침(교육인적자원부 훈령 제616호), 초·중등교육법 제25조, 고등교육법시행령 제33조, 그리고 고등교육법시행령 제41조가 본 연구에서 제기한 문제들을 발생시키는 핵심적인 법규라고 볼 수 있다.
Abstract
The purpose of this study is to analyze the structure of law and regulations related to college entrance system and the effect on students, high schools, and colleges. The major problems related to college entrance system in Korea are (1) students are too much eager to get a better score and rank in school examination and the national academic aptitude test, (2) high schools are forced to comply to the college entrance system not to achieve their educational goal, and (3) colleges and universities do not have full autonomy in the process of selecting students. Most of the previous research have focused on the external variables, such as culture, economic, and social psychology to explain these problems, there are few research dealing with them from internal perspective, that attributes the reason to the law and regulations related to college entrance system. The instruction of the ministry of education and human resources development, No. 616 regulates the method and procedures of examinations implemented in high school. That instruction enforces students to compete each other to get a better position in relative academic evaluation system. Article 25 of the act of primary and secondary education plays a key role in subordinating high school to college and university. The act of higher education and the enforcement ordinance of the act of higher education, especially article 33 and 41, are restricting the autonomy of college and university in the process of selecting students.
