스포츠 속 전략적 반칙이란, 스포츠경기에서 선수가 전략적 이득을 얻기 위해 벌칙을 받을 것을 알고도 기꺼이 고의적으로 규칙을 어기는 것을 말한다. 본고에서 다루고자 하는 문제는 스포츠에서 이러한 의도적 규칙 위반이 수용되어야 하는지, 즉 이러한 행동이 ‘경기의 일부’로 스포츠 속에서 받아들여질 만한 것인지 여부다. 이 논문의 목적은 왜 치열한 스포츠경쟁에서 전략적 반칙이 때로는 적절한지, 또한 윤리적으로 옹호가능한지 논증하는 데 있다. 이러한 연구의 목적을 달성하기 위해, 먼저 전략적 반칙의 윤리적 논쟁에 있어 핵심 키워드라고 할 수 있는 규칙의 유형과 기능에 대해 탐색하였다. 둘째, 저명한 스포츠철학자들의 부정행위에 대한 해석을 분석함으로써 스포츠에서 의도적 규칙 위반이 지닌 의미에 관해 고찰하였다. 셋째, 전략적 반칙에 관한 윤리적 논의의 이론적 토대가 되는 형식주의, 관습주의, 폭넓은 내재주의, 이들 세 이론의 핵심 주장과 논리를 요약하였다. 끝으로, 스포츠의 도덕적 한계를 지적하고 승리추구라는 실천적 의무의 개념에 대해 분석함으로써 선수들에게 실천적 의무를 윤리적 의무에 종속시키길 기대하는 것이 불합리함을 밝혀보았다. 실천적 의무와 윤리적 의무가 충돌하는 상황에서 선수에게 윤리적 의무를 다하라고 강요하는 것은 가치 있는 다른 어떤 것을 단순히 포기하란 의미가 아니라 승리추구, 즉 스포츠경기를 하는 이유를 포기하란 것과 마찬가지다.
Abstract
Strategic fouling in sport is defined as purposefully breaking the rules for strategic advantages, regardless of known penalties. This article examines whether this purposeful rule-breaking should be accepted in sport, that is, whether this type of action should be ‘part of the game.’ The goal of this article is to show that strategic fouling is often not only relevant but morally defensible in fierce sport contests. To achieve this goal, types and functions of the rules, which constitute the core of the ethical debate on strategic fouling, are discussed. Second, by looking into interpretations by sport philosophers, the significance of purposeful rule-breaking in sport is analyzed. Third, formalism, conventionalism, and broad internalism-three theories underpinning the ethical debate of strategic fouling-are introduced. Last, by stressing the moral limit of sport, as well as the practical duty calling for the pursuit of victory, it is argued that expecting athletes to subjugate practical duty to ethical duty is far from rational. To force athletes to fulfill ethical duty where practical and ethical duty collide does not simply mean picking either of the two, but giving up on the pursuit of victory, which is the foremost reason to start competition.
