Abstract
There is one striking difference between civil law and common law—the standard of proof in civil cases. The United States applies the “preponderance of evidence” standard in civil cases, requiring proof that “something is more likely than not so.” English law employs the “balance of probabilities” standard that asks whether “it is more probable than not.” In civil law countries, however, the standard of proof is the conviction of the judge with a degree of certainty(“intime conviction”), which is much higher than that in common law countries. Perplexed by this glaring disparity, some scholars have raised questions as to why civil law countries maintain their apparently irrationally high standard of proof and some have wondered whether the judges in civil law countries actually apply the proclaimed high standard of proof in civil cases. The preponderance of evidence standard in the U.S. has generally avoided criticism as a mechanism to equally allocate the error risks between the parties, until recently when some scholars advocated for varying standards of proof in civil cases. The normative discussion about the optimal level of standard of proof presupposes that the fact finder does actually apply the exogenous standard of proof as prescribed, in a consistent manner over different type of cases. However, many behavioral studies on the fact finder’s decision-making suggests that the fact finders might not actually be applying the standard of proof as the law is understood to prescribe. There have been experiments that compared preponderance of evidence standard with the beyond a reasonable doubt standard or the clear and convincing evidence standard, but none has compared the intime conviction with preponderance of evidence properly. In this paper, I review the previous studies that pertain to the fact finder’s decision-making and the application of standard of proof in civil litigation, and identify gaps and limitations in the studies. Then, I suggest several directions for future empirical research regarding the application of standards of proof in civil cases.
