현재의 지적은 100여 년 전 일제 강점기에 평판과 대나무자로 측량하여 수기로 만든 종이지적을 지금까지 그대로 사용하고 있어 지적의 디지털화에 맞지 않고, 지적공부의 등록사항이 토지의 실제 현황과 일치하지 않는 경우가 전 국토의 15퍼센트에 달하고 있어 이를 방치할 경우 심각한 문제가 발생할 우려가 있다. 이러한 문제를 해결하기 위한 사업이 지적재조사사업이며, 지적재조사사업을 제도적 안정적으로 추진하기 위하여 2011년 9월 『지적재조사에 관한 특별법』이 제정·공포되었다. 새로 제정된 『지적재조사에 관한 특별법』의 주요 내용은 기본계획과 실시계획 수립, 지적소관청의 일필지조사와 지적재조사 측량, 경계설정ㆍ결정에 대한 기준 및 경계결정에 대한 이의신청 등의 절차를 규정하였다. 또한 조정금 산정 방법과 조정금의 징수ㆍ지급, 조정금의 산정, 경계의 결정 및 이의신청 심의를 위해 지적재조사위원회와 경계결정위원회의 설치를 규정하였으며, 새로운 지적공부 작성 시 지상건축물 및 지하건축물의 위치도 등을 기재하도록 하였다. 본 연구는 산업과 기술혁신, 국토정책과 행정서비스의 혁신을 가져올 뿐만 아니라 국토와 국민의 재산을 명확히 하는 것은 물론, 소모적인 비용을 줄이고 국민의 삶을 변화시킬 특별법 제정의 필요성과 선행 법안 비교, 『지적재조사에 관한 특별법』의 주요 내용 및 고려사항 등을 고찰함으로써 지적재조사사업 시행 시 시행착오를 줄이고 이를 효율적으로 추진하는 데 도움이 되고자 한다.
Abstract
Current cadastral system in Korea has been operated on the basis of paper-based cadastral maps completed with a plane-table and bamboo rulers during the colonial period of the imperial Japan 100 years ago. Therefore, it is not only out-of-date but also unsuitable for cadastral digitalization. The rate of discrepancies between land registration and real land use is growing, and it accounts for 15 percent of the nation’s total land area. If we leave this situation as it is, it is feared that more critical problem will be happened. The land resurvey project is strongly essential for solving this problem. In September, 2011, ‘Special Act on Land Resurvey’ was established and then proclaimed for managing the stable practice of Land Resurvey Project. As to enacted details of ‘special Act on land resurvey’, establishment of a general plan and a action plan, a land parcel investigation and land resurvey surveying from competent authorities, a standard of boundary set-up and boundary settlement, a procedure of formal objection of boundary settlement were regulated. Moreover, land resurvey committee and boundary decision committee have been founded to considerate the estimating way of adjustment payment, collection and payment of adjustment payment, calculation of adjustment payment, boundary settlement and application for objections. For drawing up new cadastral record, it is necessary to include locations of buildings on ground and underground space. The aim of this study is that land resurvey project not only bring about technological innovation, national policy and administration service innovation, but also define national and public’s property right. Its another purpose is to decrease wasting cost, to establish a special act to improve the quality of our life and to compare the prior acts. This study also helps to promote land resurvey project efficiently and reduce the errors of land resurvey practice while performing this project by reviewing main contents and considerations of 'Special Act on land resurvey'.
