본 연구는 위조상품 침해 물품에 대한 통관보류 등 한국의 국경조치 제도와 그 개선방안에 대한 분석을 목적으로 한다. 국제교역이 증가하면서 위조상품의 생산 및 유입도 증가하고 있고, 대부분의 위조상품 원산지가 중국이라는 점을 감안할 때 인접국인 한국에게는 효과적인 국경조치를 취하는 것이 중대한 현안으로 대두되고 있다. 본 연구는 최근의 지식재산권 침해 적발 현황자료를 분석하여 다음과 같은 개선방안을 제시하고자 한다. 첫째, 지식재산권 집행과 관련된 장기 전략의 수립과 부처간 조율의 필요성이다. 둘째, 디지털 경제하에서 특급운송을 통해 반입되는 소규모 우편화물에 대한 단속 등 새로운 환경에 대한 대응전략의 수립이다. 셋째, 중국이나 동남아시아 국가들의 세관당국과의 국제공조를 통한 지속적인 단속의 필요성이다. 넷째, 부분품으로 국내에 반입되어 조립 생산되는 위조상품을 방지하기 위하여 통관 후 실사를 통한 전체적인 생산 및 유통과정의 무력화 필요성이다. 마지막으로 지식재산권 분야 전문가를 양성하여 세관당국 및 지식재산권 집행기관의 역량을 키우고, 권리자 및 민간단체와의 협력을 강화하여 지식재산권 보호 및 집행 강화를 위한 기본체질을 강화해 나가는 것이 필요하다.
Abstract
This paper intends to analyze Korea’s border measures against infringement of Intellectual Property Rights(IPR). As the volume of international trade grows, the risk caused by counterfeit goods is also increasing. Currently, most of counterfeit goods are originated from China. Korea has a legitimate concern to protect intellectual property rights against incoming counterfeit goods through effective border measures. This paper provides suggestions for improving existing IPR enforcement systems by analyzing current data on IPR seizures. First, it is necessary to establish comprehensive and long-term strategy involving IPR enforcement among different Ministries. Second, appropriate and effective measures should be adopted in order to respond to the influx of small express shipments under the new environment such as digital economy. Third, constant joint operations by customs authorities between countries concerned should be conducted in order to interdict counterfeit goods. Fourth, post-entry audits should be considered in order to prevent recurrent IPR violation and destroy supply chain of the counterfeit goods. Finally, more IPR experts should be trained for the IPR enforcement. Also, collaborating and sharing information with right holders and industry stakeholders should be encouraged.
