EU의 개정 반덤핑 규정에 대한 법적 분석

초록

EU는 ’95년 WTO 출범에 따른 반덤핑법 개정에 이은 가장 대폭적인 개정을 최근(’17.12, ’18.6) 두 번에 걸쳐 시행했다. 덤핑 마진 산정 방법 및 무역구제현대화를 위한 개정이 그것이다. 덤핑마진 산정방법 개정의 핵심은, 중국의 비시장경제지위 만료에 따라 기존의 사전열거(리스트 방식) 대신 심각한 왜곡(significant distortion) 개념을 도입하여, 왜곡이 있는 국가의 기업에 대해서는 정상 가격 산정시 동 기업이 제출한 생산비용 대신 제3국의 생산비용을 사용할 수 있도록 하는 것이다. 무역구제현대화 개정은 원자재 왜곡이 있는 경우 기존의 의무화된 최소부과원칙 적용을 배제할 수 있게 하였다. 두 개정 모두에서 다자환경협약과 국제노동협약 의무 이행 유인을 강화시킨 것도 주요 특징이다. 이러한 EU의 개정에 대한 분석 및 모니터링을 통해 한국 수출기업을 지원하고, 우리무역구제제도도 강화할 필요가 있다.

Abstract

The EU recently amended its antidumping regulations with new-anti dumping methodology and modernization package, which are the first major overhaul of the EU’s trade remedy rules since the establishment of the WTO in 1994. The changes on calculating dumping margins are introduced in order to disregard the costs and prices of countries whose prices and costs are significantly distorted. Also, the application of lesser duty rule will not be mandatory for imports produced using raw materials and energy distorted. Lastly, the EU will take into account social and environmental standards in its anti-dumping procedure such as price undertakings. Korea needs to monitor the development and application of the EU rules and enforce its own trade remedy rules further.
