초록

At present, there is no inter-governmental system for the protection of human rights in Asia. This is in marked contrast with Europe, the Americas and Africa, all of which have, to a greater or lesser extent, some form of inter-governmental system in this area. The present paper seeks to study and analyse the proposition for establishment of a regional human rights regime in Asia. To this end, the paper studies the international human rights framework and examines, briefly, how it evolved and functioned. Further, the paper examines the functioning of the regional human rights regimes existing in Europe, the Americas and Africa Europe. Furthermore, the paper studies the hitherto made efforts for establishment of such regimes in Asia and its sub-regions, and the level of their success. Further, ahead, the paper examines the rationality and feasibility of establishment of a regime for protection and enforcement of human rights in Asia, and proposes two-tier Human Rights Framework for Asia.
