성매매알선 등 행위의 신고자에 대해 보상금을 지급하는 것은 성매매알선 등 행위에대하여 일반 국민이 적극적으로 신고하도록 촉진 ･장려함으로써 성매매를 예방하고척결하기 위한 형사정책적인 방안의 일환이라고 할 수 있다. 또한 수사실무에서 성매매를단속함에 있어 가장 난해한 문제는 성매매 현장을 직접적으로 적발하여 범죄를 입증할 수 있는 증거를 수집하는데 많은 어려움이 있다는 점인데, 이러한 원인으로 인하여대부분의 성매매 관련 범죄의 증거는 간접증거로써 유죄의 심증을 형성한다고 해도과언이 아니라고 할 수 있다. 이는 다른 측면에서 성매매피해자, 일반 국민 등의 신고나고소를 유도할 수 있는 제도적 장치가 마련되어야 함을 역설하는 것이기도 하다. 그리하여 수사기관의 역량만으로는 부족한 단속실무에 있어서 일정한 성매매 범죄행위에대한 외부적인 감시의 눈을 확대하고 적극적으로 유도함으로써 성매매 관련 범죄의수사와 처벌을 촉진시키기 위해서는 이러한 범죄행위 제보자에 대하여 일정한 범위내에서 보상금을 지급하여 경제적인 이윤동기를 부여하는 이른바 성매매범죄신고보상금제도를 확대하여 실시할 필요성이 있는 것이다. 하지만 실제의 운영에 있어서는크게 미흡한 것이 현실인데, 이와 같은 성매매범죄의 적극적인 신고를 독려하기 위한신고보상금제도의 운영 실태에 대한 문제의식을 바탕으로 본고에서는, 우선 현행법에서규정하고 있는 성매매신고보상금제도의 주요 내용에 대하여 살펴보는데, 성매매처벌법령과 청소년성보호법령상의 규정을 상호 비교 ･검토하는 방식을 취한다. 이러한 근거규정들을 바탕으로 하여 성매매신고보상금제도를 원활하게 운영함과 동시에 확대하여운영할 수 있는 효과적인 방안에 대하여 모색해 보는데, ‘성매매 목적의 인신매매의범죄’의 명확화, 성매매신고 대상범죄의 확대, 보상금 지급의 의무화 여부 문제, 청소년성보호법상 성매매신고포상금제도의 성매매처벌법에로의 편입 등의 쟁점으로 세분화하여 서술하며, 논의를 마무리하기로 한다.
Abstract
It can be said that providing monetary reward to a person that reported theacts of arranging prostitution is a part of the criminal policy to prevent anderadicate prostitution by promoting and encouraging general public to activelyreport acts of arranging prostitution. For the purpose of encouraging theinvestigation and punishment of prostitution related crimes by expanding andactively encouraging external vigilance against certain acts of prostitutioncrimes in the practical affairs of crackdown that is lacking with investigativeagency's capacity alone, it is necessary to expand and implement a so-called'prostitution crime report monetary reward system' that provides financialgain motivation by providing monetary compensation within a certain scopefor those that reported prostitution related criminal acts. Based on the criminal view of the present condition of implementation ofreport monetary reward system designed to encourage active report ofprostitution crimes, this paper will first review the main contents ofprostitution crime report monetary reward system of existing law bycomparatively reviewing the regulations of the ordinances of the act ofprostitution punishment and the act of protection of youth from sexualexploitation. Based on such applicable provisions, it will examine an effectiveway to expand and implement the prostitution report monetary rewardsystem. This paper will conclude upon discussing in details various issuessuch as clarification of 'human trafficking crime for prostitution', expansion ofthe scope of crime of prostitution report, compulsory provision of monetaryreward, inclusion of the prostitution report monetary reward system in theact of protection against youth from sexual exploitation in the prostitutionpunishment act.
