미국 형법상 Recklessness 개념에 관한 고찰

초록

무모성(recklessness)은 영미형법상의 주요 개념의 하나임에도 불구하고 종래 국내에서이에 관한 연구가 거의 없었다. 본 논문에서는 영미형사법의 기본개념의 하나인 무모성의개념에 대하여 비교법적 관점에서 고찰하였다. 영미법상 무모성 개념은 독일형법이나우리형법상의 미필적 고의와 인식 있는 과실을 포함한 개념이라고 판단된다. 무모성은미필적 고의와 인식 있는 과실보다 더 넓은 개념으로서 양자를 모두 포괄하는 개념이다. 따라서 영미법의 무모성의 개념은 우리 형법상 고의와 과실의 어느 한 영역에 포함시키기는 어려운 개념이며, 고의와 과실의 중간영역에 있는 제3의 범죄성립의 주관적요건이라 할 수 있다. 우리형법상으로 주관적 요건과 관련하여 범죄는 고의범과 과실범으로 대별되지만, 영미법상으로 범죄는 고의범(intent), 과실범(negligence) 그리고 무모범(recklessness)의 세 가지로 분류된다고 할 수 있다. 미필적 고의나 인식 있는 과실로 행위한자를 고의범으로 처벌하는 것은 과중하고 과실범으로 처벌하는 것은 너무 경하다면,고의범과 과실범의 중간 영역에 위치하는 무모범의 개념을 설정하여 그에 합당한 법정형을 정하는 입법의 필요성도 있다는 점에서, 제3의 책임형식으로서 무모성의 개념을검토하는 것은 의미를 갖는다고 판단된다.

Abstract

In Korean law, according to Article 13 of the Criminal Code, a person mayonly be punished for intentional conduct unless it is specifically stated by theCode that negligence is sufficient. Thus, the difference between intent andnegligence is very important. The concept of recklessness falls within thearea where intent and negligence meet. In the past, recklessness was asynonym for criminal negligence. Today, however, a line is drawn betweenthese two concept, with recklessness falling on the more culpable side of theline. Recklessness requires proof that the actor disregarded a substantial andunjustifiable risk of which he is aware. It seems that reckless is similar to dolus eventualis. However, the authorof this article argues that the concept of recklessness in Anglo-Americanlaw covers the scope of both dolus eventualis and conscious negligence ofKorean law and German law. At common law, most crimes required proof ofsubjective intent. Today, for many crimes, proof of recklessness will be an alternative basis for the imposition of criminal sanctions. Thus, the author ofthis article concludes that recklessness could be a good alternative ground forthe punishment of criminals with mens rea which lies between intent andnegligence.
