Abstract
In South Korea, the rate of suspended sentences is noticeably higher than other types of sentencing. According to the Korea Legal Research and Training Institute, only 24.9% of the accused were sentenced to jai l, while 33.7% were suspended during the course of regular trials in 20 18. The most controversial part is that the court is not obliged to impos e probation to the suspension of sentence. And there is no way that a criminal court can order the probationer to make restitution to the victi m. Additionally, the law and precedents do not allow a partial suspensio n of sentence nor imposing fines concurrently to the suspension of imp risonment. Meanwhile, in the United States, (1) the sentence of probation is cat egorized as an independent type of sentencing along with fines and imp risonment, (2) restitution is imposed as one of the mandatory condition s so that the probationers have an incentive to indemnify a victim in or der to terminate the probation, (3) a court may impose a fine on the p robationer concurrently, (4) many states allow partial suspension of the sentence, and (5) probationers and parolees are subject to a warrantles s search. Probation is not granted out of a spirit of leniency nor merely letting an offender off easily. As public authority took the inherent right of re venge from individual human beings in modern society, the government is required to be more accountable for monopolizing the power of retali ation. Therefore, it is strongly encouraged to study and adopt the U.S. prob ational system for Korean legal professions.
